Fuel station "drive-off" letters

Civil debt recovery letters from ANPR-linked fuel retailers or their agents, accusing you of leaving without paying. These are often written in aggressive, threatening language but rarely reach court if it was a genuine mistake, a pump fault or a payment dispute, provided you respond properly and don't ignore it.

Toll road evasion charges

Penalty charge notices from Dart Charge (Dartford Crossing), the M6 Toll or Mersey Gateway, issued when ANPR cameras record a crossing with no payment logged against the vehicle. Genuine payments sometimes fail to register correctly against the plate.

Congestion Charge & ULEZ PCNs

Transport for London issues civil penalty charge notices for unpaid Congestion Charge or ULEZ days. They are not criminal matters, but ignoring them can escalate to bailiff (enforcement agent) action, so they still need a proper response.

Weight & low-emission zone contraventions

Other cities and authorities run their own ANPR-enforced weight-restriction and clean air zones. Notices can misidentify vehicle class, gross weight or exemption status, particularly for hired, leased or recently sold vehicles.

Grounds to challenge an ANPR or CCTV penalty

ANPR cameras are not infallible, and the systems behind them frequently get the paperwork wrong. Before you pay anything, it's worth checking whether the notice actually stands up.

  • Misread number plates: ANPR error rates rise sharply on foreign, personalised, damaged or dirty plates, and a single misread character can implicate the wrong vehicle entirely.
  • Notice not served in time: toll and congestion charge schemes operate strict statutory windows for issuing a penalty; a late notice can be invalid.
  • Vehicle sold or hired to someone else: if you weren't the keeper or driver at the time, liability can be redirected, but you'll need evidence such as a sale receipt or hire agreement.
  • Payment made but not logged: a common ULEZ and Dart Charge dispute. The charge was genuinely paid but the payment failed to match against the vehicle record.
  • Operator failed to follow its own process: many schemes have a formal representations procedure; failing to consider a timely representation properly is itself a ground for appeal.

I got a letter about a fuel station drive-off, what should I do?

Don't ignore it, but don't panic either. These are civil demands, not criminal charges, and many stem from genuine mistakes, card or pump faults, or the driver being interrupted before paying. Reply in writing setting out what actually happened and ask for the ANPR footage and till evidence. We can help you draft this and push back on inflated "admin fee" demands.

Is a Dart Charge or ULEZ penalty a criminal matter?

No. Both are civil penalty charge notices, not criminal offences, so you won't get a criminal record for non-payment. That said, if a penalty is ignored it can escalate through the civil enforcement process to bailiff (enforcement agent) action, so it's still worth challenging or resolving promptly.

Can these penalties affect my credit score?

An unpaid PCN or drive-off demand doesn't directly appear on your credit file. However, if the debt is escalated and results in a County Court Judgment because it wasn't responded to, that CCJ can affect your credit rating for up to six years. Responding early avoids that risk entirely.

What if the ANPR camera misread my number plate?

Misreads are one of the most common and most successful grounds for challenge, especially with foreign, personalised or damaged plates. Ask the operator for the camera images used to generate the notice. If the plate shown doesn't clearly match yours, that's strong evidence for a cancellation.
